We Need Your Help!

Did you know that an individuals with disabilities, who the have capacity to act for themselves, are not allowed to create their own special needs trust? The current law only allows a parent, grandparent or guardian to establish a special needs trust for an individual. A special needs trust allow individuals with disabilities to maintain government benefits, while supplementing their expenses in order to improve their quality of life. Should these individuals be forced to choose between their autonomy and their quality of life? We don’t think so, and neither does the Senate; they’ve just unanimously passed the “Special Needs Trust Fairness Act”. We need your help to reach out to House Representatives, keep the momentum going, and get this passed!

Please email David Goldfarb (dgoldfarb@naela.org), NAELA Public Policy Manager, to lobby your House Representative to support this legislation.
